TERMS AND CONDITIONS OF LOAN ITEMS

These Terms and Conditions of Loan shall apply to the Loan Agreement between Soda Vision Pte Ltd, Soda Vision Sdn Bhd, Soda Vision (Thailand) Co., Ltd. (All known as “Soda Vision”) and the “Borrower”.

  1. DEFINITIONS
    In these Terms and Conditions of Loan, “Borrower” means the person, firm, company, or corporation by whom the loan products are given.
  2. GENERAL AND DELIVERY
    2.1. The period of loan is limited for not more than 14 days.
    2.2. If Borrower needs an extension from the period of loan, Borrower must notify Soda Vision beforehand either in writing or in text form (email).
    2.3. The costs of delivery for the loan products shall be paid by Borrower.
  3. CONDITION AND HANDLING OF LOAN ITEMS
    3.1. Borrower shall take full responsibility for and in the event of loss or damage to the loan products, shall pay the replacement cost thereof, plus any shipping and handling charges.
    3.2. Borrower shall not damage or otherwise impair the physical condition of the loan products. Borrower shall indemnify and hold Soda Vision harmless against any and all damages resulting from Borrower’s (including other third-party) use of the Loan products.
  4. RETURN OF LOAN PRODUCTS
    4.1. Borrower shall return the loan products not later than the period of loan-14 days. If Borrower failed to return the loan products, an invoice shall be issued to Borrower.
    4.2. Borrower shall return the loan products to Soda Vision at Borrower expense in substantially similar condition as when it was received from Soda Vision.
    4.3. Upon return, the loan products will be inspected on its quality by Soda Vision and if loan products received is not in substantially similar condition, then title for the loan products will pass to Borrower. Soda Vision reserves the right to issue invoice of 100% on returned loan products and Borrower is responsible for all shipping and handling charges.
  5. WARNING
    Soda Vision makes no representation and is not responsible for any injury or health effects that may result from a user or third-party exposure to our loan products, including those loan products which are bright, high power, pulsing, ultraviolet and/or infrared. It is the responsibility of the Borrower to operate the loan products within the space, power and environmental conditions required for the proper operation of the loan products.
  6. SEVERABILITY
    If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
